These Terms and Conditions ("Terms") govern the provision of services by AJ Balloons ("we", "us", "our") to you, the client ("you", "your"). By placing an order with us, you agree to be bound by these Terms.

1. Quotes and Orders

All quotes provided by us are valid for 14 days from the date of issue. Prices are subject to change without notice after this period. A booking is considered confirmed only upon our written confirmation and receipt of the required deposit.

2. Deposits and Payments

To secure your event date, a non-refundable deposit of 50% of the total quoted price is required. The remaining balance is due on the day your order is delivered and installed, and is payable to us once the installation is complete, unless we have agreed a different arrangement with you in writing. Payments can be made by bank transfer, Revolut, or another method agreed upon in advance. We reserve the right to cancel any booking where the deposit has not been received by the date we specify when confirming it.

2.1 Why the deposit is non-refundable

From the moment your deposit is received, we begin spending it on your order. Specifically, we:

• reserve your event date and stop accepting other bookings for that date;
• place orders with our suppliers for the balloons and materials required for your design; and
• begin producing and assembling your decorations, including bespoke items such as personalised backdrops, foil numbers and letters, custom colour-matched balloons and printed elements.

These materials are purchased specifically for your event, are in most cases personalised to it, and cannot be returned to our suppliers, resold, or reused for another client. The deposit therefore covers costs that we have already incurred and cannot recover, together with the loss we suffer by having turned other clients away for your date.

Accordingly, once the deposit has been paid it is not refundable if you cancel your order, for any reason and at any time, whether or not production of your decorations has begun and whether or not the materials have already been delivered to us. By paying the deposit you confirm that you have read, understood and accepted this condition, and that you are asking us to begin ordering materials and producing your decorations on that basis.

3. Cancellations and Postponements

• Cancellation by You: All deposits are non-refundable, for the reasons set out in section 2.1 above. If you cancel your booking within 14 days of the event date, the full balance will also be due, as by that stage your decorations have been produced, the materials have been committed to your event, and the date can no longer realistically be resold.
• Postponement: If you need to postpone your event, please contact us as soon as possible. We will make reasonable efforts to accommodate a new date, subject to our availability. Additional charges may apply.
• Cancellation by Us: We reserve the right to cancel your booking in the event of unforeseen circumstances (e.g., illness, accidents). In such a case, any payment made, including the deposit, will be refunded in full.

4. Cooling-Off Period (Distance Bookings)

Where you book with us at a distance — by telephone, email, WhatsApp, social media or through this website — consumers are in many cases entitled to a 14-day cooling-off period under Irish and EU consumer law, including the Consumer Rights Act 2022.

That cooling-off right does not apply to our bookings, because our services fall within two categories that are expressly excluded from it:

• services connected with leisure activities where the contract provides for a specific date or period of performance — here, your event date; and
• goods that are made to your specifications or clearly personalised — here, your decorations, which are designed, coloured and often personally lettered for your event.

Your booking is therefore binding once we have confirmed it in writing and received your deposit, and the deposit and cancellation terms in sections 2 and 3 apply in full.

5. Installation and Access

You are responsible for ensuring that we have clear access to the venue for installation at the agreed-upon time. You must also ensure that the venue permits the installation of balloon decorations. We are not liable for any delays or inability to install due to access restrictions or venue policies.

6. Outdoor Installations

Balloons used in outdoor settings are subject to weather conditions such as wind, rain, and sun. While we use professional techniques to secure outdoor installations, we cannot be held responsible for the performance of balloons in adverse weather. The lifespan of balloons is significantly reduced outdoors. We are not liable for any damage to the installation caused by weather after we have completed the setup.

7. Balloon Care and Safety

Once the installation is complete, we are not responsible for any damage to the balloons. Please be aware that balloons can be a choking hazard. Children should be supervised at all times around balloons. In the event of a balloon popping, please collect and dispose of the pieces immediately.

8. Liability

Our total liability for any claim whatsoever in connection with your event or our services shall be limited to the total price paid by you for those services. We are not responsible for any injury, damage, or loss caused by the client or third parties tampering with our installations.

9. Photography

We reserve the right to take and use photographs of our balloon installations for our own promotional purposes (e.g., on our website and social media) unless you explicitly request otherwise in writing.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
